Social Security Disability Law Staff PhotoLike most hard working Americans, you have probably been contributing a portion of every paycheck you earn to the Social Security program for years. Now, you've found yourself disabled and you and your family need those benefits to pay the bills and keep food on the table. The Social Security disability lawyers of the Dick James Law Firm of Greenville, South Carolina knows the SSDI laws and can help you file for and begin receiving the benefits you deserve.

What is SSDI?

SSDI (Social Security Disability Insurance) is a tax-funded insurance program that was put in place by the federal government. Deductions are taken from your payroll (part of FICA taxes) each pay period in order to fund the program.

SSDI law is very complicated and applicants are often denied Social Security benefits the first time they apply. This is often due to mistakes in filling out the confusing paperwork. One mistake is all it takes to be denied benefits. This is why it is in your best interests to hire an experienced and knowledgeable SSDI attorney who can take care of the paperwork and dealing with government officials for you.

Who Qualifies for SSDI Benefits?

SSDI is only available to persons who have become totally disabled. You are considered to be disabled if you:

  • Cannot perform the duties of your regular job
  • Cannot be retrained and adjust to another type of work due to medical restrictions
  • Have been diagnosed with a disability that is expected to last for at least one year or is terminal.

In some cases, SSDI benefits may be reduced if the disabled person is also receiving public disability benefits or Workers' Compensation benefits.

If you have been approved for SSDI benefits, you will receive a pre-determined amount each month. This figure is determined by several factors, including your past earnings. Approval for SSDI benefits may take several months.

Who can Receive SSDI Benefits?

The SSDI system is designed to allow certain family members to receive benefits as well. Individual cases may vary, but generally, the following family members qualify:

  • Your spouse that is 62 or older
  • Your spouse of any age caring for your child who is disabled or under 16
  • Your unmarried child (18 or older) that has a disability that began prior to their 22nd birthday
  • Your unmarried child (including adopted children or in some cases stepchildren and grandchildren) under age 18 or under age 19 if still in secondary school full time
  • In some cases, your ex-spouse if you were married for at least ten years, they are single and over 62
