ATV Accidents (All-Terrain Vehicles)

ATV’s Accidents due to Stuck Throttles

If your throttle gets stuck while riding, you must be able to think and act quickly so you can avoid a crash or rollover. If your throttle sticks, you should try to twist the throttle back and forth a few times. If the throttle cable is stuck, this movement may work it free. You can also try to close the throttle. If this doesn’t work, then you can hit the kill switch, which will stop power to the rear wheels but not to the engine right away. The engine takes a little longer to come to a complete stop. A stuck throttle can be a very serious and dangerous maintenance issue.

Since 2000, countless defective product lawsuits have been filed against ATV manufacturers and distributors because of failure to warn of potential injuries. It is not always easy to get a defective product off the market. The Consumer Product Safety Commission (CPSC) has had a particularly difficult time regulating ATVs. About 22 million people ride ATVs in the U.S. and over 700 die in ATV accident each year. Twenty-five prevent of those are under the age of 16.

Types of ATV Defects

Many ATV rollover accidents are caused by unstable design. Design defects are errors in the initial product design that make the ATV dangerous. Attorneys must prove that the harmful product was defectively designed. Manufacturing defects are flaws that occurred during the manufacturing process; the manufacturer will be at fault if the defect results in injury, regardless of safety precautions taken. Failure to worn means that manufacturers did not adequately warn consumers of all possible dangers and/or did not provide instructions for proper use.
