Social Security Disability Insurance (SSDI) Questions

Anderson, Greenville, Spartanburg, South Carolina

On this Web page, you will find commonly asked questions about Social Security Disability Insurance (SSDI). Contact an SSDI benefits attorney for more detailed information, or if you have questions about your specific case.

What are Social Security Disability Insurance (SSDI) benefits?

Social Security Disability Insurance (SSDI) are benefits awarded to those who become disabled and can not work. To qualify for these benefits, which are issued by the Social Security Administration, you must have a physical or mental impairment that is expected to result in death, or has lasted or is expected to last for a continuous 12 months or more.

What if the Social Security Administration denies my claim for SSI benefits?

If your claim is denied, you have 65 days to appeal and ask for a hearing to present your claim to an administrative law judge. This 65-day period starts from the date stamped on your denial letter. One of the largest mistakes you make is missing this deadline. If you do so, you will have to start over and wait several months for the decision (which will likely be a second denial).

If I appeal the decision, do I have a chance to win my claim?

Certainly. In fact, a majority of SSDI claims are denied initially, and then approved during the appeal process. Your initial claim may be denied for many reasons. Maybe you forgot important medical information or did not list all the limitations caused by your disabling medical condition. Or perhaps you have an illness that is hard for doctors to diagnose, but you are completely disabled. With situations such as these, a Social Security Disability attorney can review your records and help you compile a claim that has a better chance of being approved.

How far back can I receive benefits if my claim is finally approved?

You can only receive past-due benefits one year prior to the date you filled out your initial application, even if you are found to be disabled earlier than that. There are, however, other factors that are considered, such as previous applications and denials. That is why it is so important to speak to a lawyer who handles SSDI claims.

How long does a Social Security claim take

It is hard to tell with these kinds of claims. SSDI claims can take anywhere from several months to a few years. It can take three to four months from the time you apply until the final decision is made. If denied, there is a reconsideration period that could take another four months for a decision. It could then take anywhere from 12 to 18 months before you can get a hearing with an administrative law judge. The judge can take one month to many months to reach a decision. Therefore, it is hard to tell how long your SSDI claim will take.
