Types of Work Visas

There are two kinds of work visas that can be obtained in the United States. These are the H1B Visa and the H2B Visa. The type you will need depends on the details relating to your work in this country.

H1B Visa

The H1B Visa is the most popular type of visa to obtain because it allows the holder to apply for a green card, which will allow them to obtain legal permanent residency, if approved.

The H1B Visa is a temporary work visa. It is given to foreign workers to enable them to legally work in the United States for a specified period of time. It is also reserved for workers who are involved in specialty occupations.

Qualifying occupations are defined as requiring practical and theoretical application of specialized knowledge in a certain field and requiring the attainment of a Bachelor's degree or equivalent as a minimum. An exception to this rule may be a fashion model who exhibits distinguished merit and ability. These occupations include, but are not limited to:

  • The Arts
  • Accounting
  • Architecture
  • Biotechnology
  • Business specialties
  • Education
  • Engineering
  • Law
  • Mathematics
  • Medicine and health
  • Physical sciences
  • Social sciences
  • Theology

The duration of stay allowed to those possessing the H1B Visa is generally three years. This stay may be extended to six years on the same visa. The only exceptions involve a labor certification that is pending for a one year extension, or a 1-140 Form that has been approved for a three year extension.

H2B Visa

The H2B Visa is also a temporary work visa, but it is designed for foreign workers who wish to work in the United States for a specific period of time for seasonal jobs. These types of jobs may include:

  • Chefs
  • Construction workers
  • Golf courses
  • Hospitality workers
  • Hotels/motels
  • Janitorial
  • Landscaping
  • Maintenance
  • Manufacturing
  • Resorts and theme parks
  • Restaurants and bars
  • Retail stores
  • Ride operators
  • Security
  • Ski resorts
  • Ticket sales/cruise ships
  • Warehouses

To qualify for an H2B Visa, the employee must have been offered a temporary job by a United States employer and must be able to meet the minimum requirements of that job. The employee must intend to return to their home country when the job is completed and the visa has expired.

The H2B visa lasts for the duration of the seasonal job, but for no longer than one year at a time. The employer can extend the visa for up to three years under certain circumstances. The H2B Visa is only available to non-immigrant workers that are not working in the agricultural field.

These are the most basic regulations concerning work visas.
